En el año 2020, el IDOPPRIL recibió 40,145 notificaciones de empleados afectados por incidentes en sus jornadas habituales, de los cuales 31,890 corresponden a accidentes de trabajo y 8,255 a enfermedades profesionales. La situación en materia de seguridad y salud laboral en RD tiene todavía un largo camino que recorrer, sin embargo hay avances notables.

Hoy celebramos el Día Mundial de la Salud y la Seguridad en el Trabajo, que este año se va a centrar en la creación de una cultura de seguridad y salud positiva, ¿puede explicarnos qué significa esto?
“Actuar juntos para construir una cultura positiva de seguridad y salud” es el lema que ha elegido la Organización Internacional del Trabajo (OIT) este año por el Día Mundial de la Seguridad y la Salud en el Trabajo que se celebra cada 28 de abril. En este día, que se celebra anualmente, se promueve la prevención de los accidentes y las enfermedades profesionales en todo el mundo. El Día Mundial de la Seguridad y la Salud en el Trabajo 2022 se centra en potenciar el diálogo social hacia una cultura de la seguridad y la salud, además de impulsar con todo esto la justicia social y promover el trabajo decente. Por ello, la OIT busca centrarse en el tema de la participación y el diálogo social en la creación de una cultura positiva de seguridad y salud.

¿Qué es la seguridad laboral y salud ocupacional y qué beneficios aporta a los empleados?
Podemos afirmar que la salud ocupacional, al mantener y mejorar la salud de los empleados dentro de las empresas donde desarrollan su trabajo diario, garantiza no solo la seguridad y bienestar de estos, sino que extiende sus beneficios a la propia empresa que disfruta de trabajadores motivados y con una mayor implicación laboral.

¿Por qué es necesario invertir en la salud y seguridad de los trabajadores/empleados?
Se debe invertir en seguridad y salud de los trabajadores, ya que la misma puede constituir, y de hecho constituye, tanto un deber moral y una responsabilidad social, como una conveniencia económica y una ventaja competitiva, independiente de que las empresas deben estar en orden en cuanto al cumplimiento de las disposiciones legales que les son aplicables en la materia.

¿Cómo estamos en materia de salud y seguridad en nuestro país?
Es evidente, que nos falta mucho camino por recorrer. Sin embargo, son notables algunos avances. Desde que se instituyó el 9 de mayo de 2001 el Sistema Dominicano de Seguridad Social con la promulgación de la Ley 87-01, hay que reconocer que el mismo ha crecido y se ha fortalecido para beneficio del pueblo dominicano. Sin embargo, el reglamento de seguridad y salud en el trabajo, Decreto Núm. 522-06, del 17 de octubre de 2006, sus anexos y las resoluciones complementarias, se encuentran hoy día obsoletos en relación a los avances tecnológicos y los nuevos tiempos, sobre todo después de las experiencias aprendidas durante la pandemia. Los tiempos cambian, todo cambia, por tanto, las organizaciones deben estar preparadas no sólo para enfrentar un huracán, terremoto o huelga, sino también epidemias y pandemias que podrían paralizar sus operaciones. Por todo lo anterior, es imperativo y urgente la actualización de nuestras leyes y normas en materia de seguridad laboral, salud ocupacional y demás disciplinas afines.

¿Cómo definiría la actual situación de la prevención en RD?
La situación es aún muy crítica. La causa principal es que el país no cuenta con una cultura de prevención en materia de seguridad y salud ocupacional. Las instituciones involucradas en la materia, aunque han venido trabajando a través de la sensibilización con campañas educativas y preventivas, de la mano con el Ministerio de Trabajo, aún no se evidencia la existencia de una cultura de prevención en la que trabajadores/colaboradores, profesionales de la seguridad y salud y empresarios estén realmente comprometidos. Es tanto así, que en la República Dominicana no se cuenta con una Política Nacional de Prevención de Accidentes Laborales y Enfermedades Profesionales.

Prevenir es el objetivo, ¿cuáles son los principales desafíos en RD para conseguirlo?
1. Hacer una reingeniería o reforma total del Reglamento de Seguridad y Salud en el Trabajo, Decreto Núm. 522-06.2. Hacer una reingeniería o reforma total del la DGHSI, iniciando por actualizar su nombre a los nuevos tiempos como por ejemplo DGSYST, Dirección General de la Seguridad y Salud en el Trabajo. Redefinir la misión y las funciones de este organismo. Es obligatoria y necesaria la creación de un equipo de Inspectores de Seguridad y Salud en el Trabajo que deben ser profesionales graduados en las distintas disciplinas de la seguridad y salud ocupacional para la inspección y fiscalización del cumplimiento del nuevo Reglamento SST.

¿Tenemos datos locales sobre cuánta es la mortalidad por enfermedades y accidentes laborales, o casos por dolencias profesionales?
Para el año 2020, el IDOPPRIL recibió 40 mil 145 notificaciones de empleados afectados por incidentes en sus jornadas habituales, de los cuales 31 mil 890 reportes corresponden a accidentes de trabajo (AT) y 8 mil 255 a enfermedades profesionales (EP). De los accidentes laborales reportados, 28 mil 515, corresponden al sector privado, mientras que el sector público registró 11 mil 630 casos. El grupo con mayor reporte de AT y EP correspondió a Salud y Servicios Sociales con 10 mil 82 reportes. Según las fuentes estadísticas, del total de afectados, hubo un mayor número de reportes de trabajadores del género masculino, con un total de veinte y cuatro mil 652, si lo comparamos con los quince mil 469, del género femenino. Los trabajadores cuyas edades oscilan entre 20-29 años, siguen siendo los que más reportaron o registraron accidentes de trabajo, con 12 mil 952 reportes en el año 2020, seguido por los de 30 a 39 años, quienes obtuvieron una cifra de 12 mil 784; los de 40-49 años alcanzaron 8 mil 99.

La prevención es la clave de la gestión de riesgos, ¿qué se debe hacer para revertir el índice de accidentes fatales laborales en el país?
La única forma de prevenir las fatalidades en el trabajo es actuando a tiempo y tomando todas las medidas preventivas posibles antes de que ocurran los eventos adversos que dan origen a los accidentes de trabajo y enfermedades ocupacionales. Debemos formar a más profesionales en el área de seguridad laboral, higiene industrial, salud ocupacional, medicina del trabajo, ergonomía y psicosociología del trabajo entre otras disciplinas afines a la prevención de riesgos laborales ya que en la actualidad la mayoría de quienes ejercen no han tenido la oportunidad de obtener un título universitario ni siquiera de técnico Superior en PRL o SYSO, entre otros. Son todavía un grupo muy reducido quienes poseen por lo menos un Máster o Especialidad.

¿Hasta dónde pueden controlarse y reducirse los riesgos laborales?
Todos los accidentes de trabajo y enfermedades ocupacionales son evitables, absolutamente todos. El límite es el que la alta gerencia de la organización se ponga. Es decir, es ilimitado todo lo que podamos hacer para lograr la meta “Cero Daño en el Trabajo”.

¿Cuál es el balance de la salud física y mental en el trabajo en el último año para nuestro país?
No entraremos en detalles estadísticos, sin embargo, existen situaciones que son muy evidentes, al menos para los profesionales de la seguridad y salud que hacemos vida en República Dominicana ya que somos quienes implementamos los Sistemas de Gestión en Seguridad y Salud Ocupacional según las exigencias de la legislación nacional. Algunas de estás situaciones son por ejemplo el desconocimiento profundo que hay sobre el Riesgo Ergonómico o Biomecánico, al no existir en las organizaciones programas de prevención de lesiones musculoesqueléticas o programas de ergonomía, por creer que la faja lumbar es la más eficiente forma de proteger al trabajador, cosa que es totalmente falsa, tenemos consecuencias de salud pública y social como lo es la gran cantidad de trabajadores con lesiones a nivel de columna y espalda baja (hernias discales y algias de columna en general). Cuando realizamos los análisis de peligros y riesgos por puestos de trabajo o las matrices IPER “Identificación de Peligros, Evaluación y Control de Riesgos”, encontramos que en la mayoría de los casos No existe ningún tipo de controles para reducir y controlar los riesgos, o simplemente los controles se limitan al uso de los EPP (Equipo de Protección Personal), sin tomar en cuenta la capacitación y sensibilización que debe hacerse a los colaboradores para que tengan cada vez más conciencia sobre su propia seguridad. Además, No existe conciencia de que los riesgos laborales deben controlarse primeramente en la fuente que lo genera y de último dotando al trabajador de un EPP (Equipo de Protección Personal). Otro Factor subestimado es el Riesgo Psicosocial, que es evidente debido a los altos índices de estrés laboral traducido en los trabajadores en forma de enfermedades de todo tipo.

¿Qué nos espera en 2022-23 en el ámbito de la prevención de riesgos laborales en RD?
De no actuar de manera preventiva desde el Estado y desde las empresas u organizaciones que componen el aparato productivo nacional, seguiremos teniendo unas estadísticas de accidentes y enfermedades ocupacionales disparadas como ha sido por muchos años en el país. Se requieren reformas profundas de la legislación nacional y se requieren más universidades con programas académicos específicos sobre la materia.

¿Cómo podemos generar una cultura más preventiva en las empresas/organizaciones?
Definitivamente la única forma de lograrlo es haciendo que el empresario, es decir la alta gerencia, se involucre y se sienta moral y legalmente responsable de lo que le pase y deje de pasar a sus colaboradores, entendiendo por fin que ellos están bajo su absoluta responsabilidad. Debe lograrse que los empresarios y los supervisores cambien su mentalidad en relación con los accidentes y enfermedades en el trabajo, haciéndolos legalmente (administrativa, civil y penalmente) responsables. La seguridad y salud debe ser responsabilidad de todos los involucrados en los procesos productivos o de servicios no únicamente del colaborador.

¿Qué recomendaría a una empresa u organización para abordar con seriedad políticas de prevención y salud en el trabajo?
Primeramente, que contraten los servicios de un asesor técnico en seguridad laboral, salud ocupacional y ergonomía, que realmente sea un experto en la materia. Que aporten todos los recursos que sean necesarios incluyendo el tiempo durante jornada de trabajo para que los colaboradores se formen en todos los temas relacionados con la prevención de riesgos laborales. Los cursos y talleres deben ser personalizados a la organización, es decir, acorde a los riesgos específicos del centro e trabajo. Evitar las capacitaciones genéricas. Que todos los años evalúen la salud ocupacional de sus colaboradores a través de jornadas que permitan un buen diagnostico de la condiciones físicas y mentales de su gente. Que lo hagan acorde a los peligros y riesgos específicos de cada puesto de trabajo. Evitar evaluaciones genéricas para todos por igual. Y que midan los resultados. Lo que no se mide no se mejora.

¿Cuáles considera que son los principales avances que se han conseguido en nuestro país en prevención de riesgos laborales?
Aunque aún son muy pocas las organizaciones que han logrado cumplir algunas de las exigencias del actual Reglamento de Seguridad y Salud en el Trabajo, Decreto Núm. 522-06. Los profesionales de la seguridad y saludocupacional observamos con agrado un incremento significativo en la implementación de las Brigadas de Emergencia. Algunas organizaciones han tomado como cultura la capacitación anual en esta materia y los ejercicios de simulacros evaluados. Hemos visto un incremento en la conformación de los Comité Mixtos, sin embargo, No están logrando cumplir sus objetivos por diversas razones, entre ellas, no tienen el apoyo real de la gerencia ni tienen un asesor técnico especialista SYSO que los guíe y oriente a resultados. Se han logrado muchas mejoras en lo que respecta al seguro de riesgos laborales.

¿Quedan asignaturas pendientes?
Muchas, entre ellas, la implementación de la Ergonomía, de la Higiene Industrial a través de la evaluación cuantitativa de los riesgos físicos, químicos y biológicos, queda pendiente también la evaluación y prevención de los Riesgos Psicosociales en el Trabajo, el monitoreo anual de la salud ocupacional preventiva de los trabajadores, entre otros.

Si pudiera, ¿qué cambiaría de la normativa vigente?
Lo primero que yo haría sería una reforma profunda del Reglamento de Seguridad y Salud en el Trabajo, Decreto Núm. 522-06, del 17 de octubre de 2006, sus anexos y las resoluciones complementarias. Crearía mesas técnicas con el INDOCAL para la redacción y aprobación de las Normas Técnicas Nordom especificas relativas a la Seguridad Laboral, Salud Ocupacional, Ergonomía, Prevención de Incendios, Higiene Industrial, Riesgos Psicosociales, Sistemas de Gestión de SYSO, entre otros y gestionaría su aprobación por decreto como “Obligatorias”. Redefiniría la organización interna y las funciones de la DGHSI y los sacaría de sus oficinas para que estén permanentemente Fiscalizando In Situ Inspeccionando y sancionando los incumplimientos del nuevo Reglamento, el cual debe ya incluir los decretos complementarios y las normas técnicas en la materia. Incrementaría de manera significativa el valor de las multas con el objeto de lograr un significativo mayor nivel de cumplimiento de parte del sector empresarial.
